Join KEI as it hosts a luncheon program corresponding with the release of what will be the seventeenth Paper in its Academic Paper Series. Conventional wisdom suggests that the KORUS FTA should reduce legal disputes between the United States and the Republic of Korea. However, because of the two countries’ differing legal systems, the KORUS FTA has the potential to increase and diversify the legal disputes between the two countries—on investment, nullification and impairment claims, forum shopping, NTBs, to name a few. The nature of these issues is significantly different from the more typical legal disputes the two countries have had to deal with thus far. Identifying and effectively dealing with the key discrepancies in the two legal systems as soon as possible will prove critical to the future success of the KORUS FTA.
